On March 3, Judge Camille Kenny, in the New Jersey Superior
Court, Law Division, refused to grant a motion to dismiss my lawsuit against Kean
University. I am meeting with a private attorney to discuss future handling of the case on my behalf.
Although the Council of New Jersey State College Locals—CNJSCL—has taken
the position that my claims are not technically related to our union activities, I would argue
that the lawsuit has the potential to increase the rights of adjunct
faculty. The lawsuit challenges the traditional notion that as "at-will" employees,
adjunct faculty have no recourse when their contracts are not renewed; it is attempting to establish the principle that when the discharge of an
adjunct
faculty member is in retaliation for asserting federal rights, such
discharge
violates public policy, and is actionable.
